Terms of Service

1. Acceptance of Terms

By accessing and using the Creative Economy Survey of West Java website at ekrafjabar.official.id (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by the Department of Tourism and Culture of West Java Province (Dinas Pariwisata dan Kebudayaan Provinsi Jawa Barat), hereinafter referred to as "we", "us", or "the Operator".

2. Description of Service

The Service is a web-based survey platform designed to collect data on the state of the creative economy across 27 cities and regencies in West Java Province, Indonesia. The platform enables authorized government institutions and regional agencies to submit survey responses regarding creative economy indicators in their respective areas.

3. Eligibility

The Service is intended for use by:

• Authorized representatives of local government agencies (Organisasi Perangkat Daerah / OPD) in West Java Province
• Officials designated by their respective institutions to complete the survey
• Individuals who are at least 17 years of age

By using this Service, you represent and warrant that you have the authority to act on behalf of your institution and that the information you provide is accurate and truthful.

4. User Obligations

By using the Service, you agree to:

• Provide accurate, complete, and truthful information in all survey responses
• Keep your PIN and email credentials confidential and not share them with unauthorized persons
• Not attempt to manipulate, disrupt, or interfere with the proper functioning of the Service
• Not submit false, misleading, defamatory, or illegal content
• Not upload files containing malware, viruses, or harmful code
• Comply with all applicable laws and regulations of the Republic of Indonesia

5. Intellectual Property

All content, design, logos, text, graphics, and software constituting the Service are the property of the Department of Tourism and Culture of West Java Province or its licensors and are protected by applicable intellectual property laws of the Republic of Indonesia.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without prior written consent from the Operator.

6. Survey Data and Responses

• All survey responses submitted through the Service become the property of the Operator for the purpose of policy analysis, research, and regional development planning.
• Aggregated and anonymized data derived from survey responses may be published in official reports without identifying individual respondents.
• Individual responses will be treated as confidential and will not be disclosed to third parties except as described in our Privacy Policy.

7. File Uploads

The Service may allow you to upload supporting documents. By uploading files, you:

• Confirm that you have the right to share such files and that they do not infringe on any third-party rights
• Acknowledge that uploaded files will be stored on Google Drive and are subject to Google's Terms of Service
• Agree that uploaded files are limited to the following formats: PDF, DOC, DOCX, XLS, XLSX, PPT, PPTX, JPEG, PNG, with a maximum size of 10MB per file

8. Data Protection

We are committed to protecting your personal data in accordance with Law No. 27 of 2022 on Personal Data Protection (UU PDP). For full details on how we collect, process, store, and protect your personal data, please refer to our Privacy Policy.

By using the Service, you consent to the collection and processing of your personal data as described in the Privacy Policy. You retain all rights granted to you under UU PDP, including the right to access, rectify, delete, and port your personal data.

9. Availability and Modifications

• We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free access.
• We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without prior notice.
• We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable Indonesian law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of data, loss of revenue, or interruption of service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from or in connection with these Terms shall be resolved through:

1. Amicable Settlement: The parties shall first attempt to resolve any dispute through good faith negotiation.
2. Mediation: If negotiation fails, the dispute shall be submitted to mediation.
3. Jurisdiction: If mediation fails, the dispute shall be submitted to the competent court in Bandung, West Java, Indonesia.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
